HARTFORD, Dec. 22 (Press Release)  – Consumer Protection Commissioner Jerry Farrell, Jr. is announcing that his agency has filed complaints against Industrial Mattress, LLC, and Ellianna Bedding, both of Brooklyn, N.Y., for alleged violations of the state’s bedding and upholstered furniture laws and the Connecticut Unfair Trade Practices Act. Since spring of 2009, both companies have held Connecticut licenses for the manufacture of bedding and upholstered furniture.
The state charges that both companies sold, offered for sale, or distributed bedding products in Connecticut without being sanitized, and without proper law tags. If true, these allegations are grounds for license suspension or revocation, reprimand, civil penalty, or denial of license renewal.
“The regulation of bedding and upholstered furniture has a direct impact on public health and safety and is an issue we take very seriously,†Farrell said today. “The requirements help ensure that products offered for sale in Connecticut are properly produced and sanitized to prevent injury and halt the potential spread of pests and illness.â€
The department routinely inspects retailers of bedding and upholstered furniture to ensure that they are properly licensed and that their products are manufactured, distributed and sold in compliance with the law.
Ellianna Bedding allegedly sold noncompliant products at Mario’s Discount Furniture at 439 Ella Grasso Boulevard in New Haven. Industrial Mattress products were sold at Pepe’s Furniture of 199 Affleck St. in Hartford.
Neither manufacturer appeared at a compliance meeting held by the Department of Consumer Protection in November. The meeting offered an opportunity for the companies to show compliance with all lawful requirements to retain their licenses. The department has now scheduled a formal administrative hearing for Jan. 13, 2010, at its Hartford offices to consider penalties for the two manufacturers, which can include civil penalties, restitution, and license suspension or revocation.
