Purchasers of some Costco branded dog food could receive money as the result of a class action suit accusing the company of falsely advertising its food as being grain free. The dog foods were manufactured by Diamond Pet Foods.
The dog food is under the Kirkland store brand and is for Nature’s Bounty and Taste of The Wild, which by the way I have used for more than 10 years.
Purchasers with or without receipts can get as much as $100 from the proposed settlement. With a receipt you could get up to $100 and $5 without. Costco keeps track of all your purchases so get a copy of your receipt from the membership desk.
Request for payment should be made by Oct. 4 by filling out this form, which includes registering.
The recent proposed settlement covers anyone who bought the affected products after March 12, 2017 and up to and including May 3, 2021. The settlement, which has had preliminary approval, still needs a final approval from a federal judge. Diamond denied it did anything wrong – which is standard in this kinds of suits – but still agreed to the settlement.
The 2020 suit says that Costco’s and Diamond’s claims that the ingredients the safety of the Kirkland Products for dogs that may be “sensitive or allergic to grains, are false.
“In fact, the Kirkland Products contain significant amounts wheat.
“Plaintiffs’independent analysis of the ingredients of the Kirkland Products found that the Kirkland Products contain material amounts of wheat using the industry standard Q‐PCR method of DNA testing. By any scientific standard, the wheat found within the Kirkland Products is greater than trace.”
